These terms govern access to and use of the Landalog platform — the website, web applications, driver mobile application and related services — provided by Landalog (Pty) Ltd, a company registered in the Republic of South Africa. By creating an account or using the platform you agree to these terms.
1. The service
Landalog provides a software platform for managing regulated-waste operations: capturing collections, recording chain-of-custody events, generating removal certificates and providing client access to compliance records. The platform is provided to waste-management operators (each a “Customer”) under a subscription, and to their staff and clients as authorised users.
Landalog is a record-keeping and workflow tool. The Customer remains solely responsible for its own regulatory compliance, including waste licensing, transport permits, IPWIS registration and reporting obligations. Landalog does not provide legal or regulatory advice.
2. Accounts and access
Accounts are provisioned by Landalog (for Customer administrators) or by Customer administrators (for drivers and client users). You must keep credentials confidential and are responsible for all activity under your account. Notify us immediately of any suspected unauthorised access.
We may suspend access where we reasonably believe an account is compromised, used in breach of these terms, or where a Customer's subscription has lapsed.
3. Subscriptions and fees
Subscription plans, included usage and fees are set out in the applicable order form or plan schedule. Fees are payable monthly in advance in South African Rand unless agreed otherwise. We may adjust fees on 60 days' written notice, effective from the next billing cycle.
Plans are month-to-month after any agreed pilot period unless an order form states a fixed term. Either party may cancel with 30 days' written notice; fees already paid are non-refundable except where required by law.
4. Customer data and chain-of-custody records
The Customer owns all data captured through the platform, including collection records, signatures, photographs, GPS coordinates, weights and certificates (“Customer Data”). We process Customer Data only to provide and improve the service, as described in our Privacy Policy and any data processing terms.
Chain-of-custody records are designed to be tamper-evident: completed custody events and audit-log entries cannot be edited through the platform. The Customer acknowledges that this immutability is a feature of the service and necessary for its evidentiary value.
On termination, the Customer may export Customer Data in open formats for 60 days, after which we may delete it, subject to statutory retention obligations applicable to waste records.
5. Acceptable use
You must not:
- use the platform to falsify, backdate or misrepresent chain-of-custody records;
- attempt to access another tenant's data or circumvent access controls;
- reverse engineer, scan or test the platform's security without written permission;
- upload unlawful content or content that infringes third-party rights;
- resell or sublicense access except as expressly agreed in writing.
6. Service levels and support
We target 99.5% monthly availability for the hosted platform, excluding scheduled maintenance notified in advance and events beyond our reasonable control. The driver application is offline-first by design: capture functionality continues without connectivity and synchronises when a connection is restored.
Support hours, channels and response targets are described on our Support page or in the applicable order form.
7. Intellectual property
Landalog and its licensors own the platform, including all software, designs and trade marks. The Customer receives a limited, non-exclusive, non-transferable right to use the platform for its internal business during the subscription. Feedback you provide may be used to improve the service without obligation.
8. Warranties and disclaimers
We warrant that the platform will perform materially as described. Except as expressly stated, the platform is provided “as is” and we disclaim all other warranties to the extent permitted by law. We do not warrant that the platform will be error-free or uninterrupted, or that it satisfies any specific regulatory requirement applicable to the Customer.
9. Liability
To the extent permitted by law, neither party is liable for indirect or consequential loss, and each party's aggregate liability under these terms is limited to the fees paid by the Customer in the 12 months preceding the claim. Nothing limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under South African law, including under the Consumer Protection Act where it applies.
10. Data protection
Each party will comply with the Protection of Personal Information Act, 2013 (POPIA) in relation to personal information processed in connection with the platform. Our Privacy Policy describes how we process personal information; where we process personal information on the Customer's behalf, we do so as operator on the Customer's documented instructions.
11. Termination
Either party may terminate for material breach not remedied within 14 days of written notice, or immediately on the other party's insolvency. On termination, access ends and section 4 (data export) applies.
12. General
These terms are governed by South African law, and the parties consent to the jurisdiction of the courts of the Western Cape Division, Cape Town. We may update these terms on 30 days' notice; continued use after the effective date constitutes acceptance. Notices must be in writing to the addresses on the order form or to hello@landalog.co.za.
